1. The Pixer service
Pixer provides AI-powered tools for product photography, marketplace-ready listing images, generated product assets, and related creative workflows. Current and future features may include image generation, image editing, product analysis, background removal, product cards, videos, creator-program tools, analytics, APIs, and other services we make available.
Pixer is independent and is not affiliated with Amazon.com, Inc. References to Amazon or other marketplaces describe intended use cases and do not imply endorsement, certification, or partnership.
2. Eligibility and accounts
- You must be at least 16 years old, or the minimum age required in your jurisdiction, to use Pixer.
- You must provide accurate account information and keep your login access secure.
- You are responsible for all activity under your account.
- If you use Pixer for a company, brand, marketplace seller, or other organization, you represent that you have authority to accept these Terms on its behalf.
3. Your uploads and inputs
You retain your rights in the photos, prompts, product descriptions, logos, packaging, reference images, videos, brand assets, and other materials you upload or provide to Pixer ("Inputs").
You grant Pixer a limited license to host, copy, process, transmit, display, and use your Inputs as needed to provide, maintain, secure, and improve the service, including sending Inputs to third-party providers that help power Pixer.
You represent that you have all rights, licenses, and permissions needed to upload and use your Inputs with Pixer. Do not upload materials that infringe another person's copyright, trademark, publicity, privacy, contractual, marketplace, or other rights.
4. Generated outputs and commercial use
As between you and Pixer, and to the maximum extent permitted by applicable law, you may use the images and other assets generated for you by Pixer ("Outputs") for personal or commercial purposes, including marketplace listings, ads, social posts, product pages, and brand materials.
Pixer helps you create product visuals, but Pixer does not provide legal clearance, intellectual-property review, marketplace approval, or professional legal advice. By using Pixer, you agree that you are responsible for reviewing Outputs before use and confirming that they are legally safe and appropriate for your intended use, including any copyright, trademark, design, publicity, privacy, advertising, platform, and marketplace requirements.
AI-generated content may resemble existing works, brands, styles, products, people, or other protected materials. Your rights in Outputs may be limited by applicable law, by rights in your Inputs, by third-party rights, or by the terms of services and marketplaces where you use the Outputs.
5. AI output quality and marketplace review
AI systems are probabilistic and may produce inaccurate, incomplete, distorted, offensive, non-compliant, or unsuitable Outputs. Product labels, text, logos, hands, faces, proportions, dimensions, materials, shadows, reflections, and packaging details may be incorrect.
Pixer is designed to help create marketplace-ready visuals, but we do not guarantee that any Output will be accepted by Amazon, Shopify, Etsy, Walmart, TikTok Shop, Meta, Google, or any other marketplace, ad network, platform, regulator, or third party. You must perform human review before publishing, selling, advertising, or relying on any Output.
6. Credits, payments, and refunds
Pixer may offer free credits, paid credit packs, subscriptions, trials, promotions, or other paid features. Credit amounts, prices, feature availability, and credit costs may change over time.
Payments are processed through Stripe or another payment provider. You authorize us and our payment provider to charge the payment method you provide for purchases you make.
Unless required by law or stated otherwise at checkout, purchases of credits and generated digital services are generally final once credits are delivered or used. If a technical issue prevents access to purchased credits or prevents a generation from completing, contact us so we can review the issue.
7. Acceptable use
You may not use Pixer to:
- Violate any law, regulation, marketplace policy, or third-party right.
- Upload or generate content that infringes copyright, trademarks, design rights, publicity rights, privacy rights, or trade secrets.
- Create deceptive, fraudulent, counterfeit, misleading, or unlawful product listings, ads, or reviews.
- Misrepresent AI-generated or edited content where disclosure is legally or platform-required.
- Upload private or sensitive personal data without the required permission.
- Create abusive, hateful, harassing, sexually explicit, exploitative, violent, political-manipulation, self-harm, or otherwise harmful content.
- Use portraits, likenesses, names, voices, or identities of people without appropriate rights or consent.
- Reverse engineer, scrape, overload, attack, benchmark for competitive purposes, or interfere with Pixer.
- Use Outputs, service data, or platform access to train competing AI systems unless we expressly allow it in writing.
8. Creator and influencer program
If you participate in Pixer's creator, influencer, affiliate, blogger, or referral programs, you must submit truthful information and comply with applicable advertising, disclosure, platform, tax, and payment rules. We may review submitted videos, traffic, engagement, referrals, and payout requests.
We may reject submissions, withhold or reverse payouts, suspend accounts, or ban participants if we believe there is fraud, bot traffic, fake engagement, policy abuse, misleading promotion, rights violations, or other conduct that harms Pixer, users, platforms, or third parties.
9. Our intellectual property
Pixer, including our software, design, brand, logo, workflows, prompts, templates, styles, UI, documentation, and other service materials, is owned by Pixer or our licensors. These Terms do not give you ownership of Pixer itself.
10. Third-party services
Pixer uses and links to third-party services such as payment processors, OAuth providers, AI providers, storage providers, hosting providers, marketplaces, and social platforms. We are not responsible for third-party services, and their own terms and policies may apply.
11. Service changes and availability
Pixer is still evolving. We may add, change, suspend, limit, or discontinue features, models, prices, credits, storage behavior, output formats, or policies. We do not guarantee uninterrupted availability, particular model behavior, specific output quality, or continued support for any feature.
12. Suspension and termination
We may suspend or terminate access to Pixer if we believe you violated these Terms, created legal or security risk, abused credits or promotions, attempted fraud, harmed the service, or used Pixer in a way that may expose us or others to liability.
You may stop using Pixer at any time. Certain sections of these Terms survive termination, including provisions about rights, payments, disclaimers, liability limits, and dispute-related terms.
13. Disclaimers
Pixer is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability, and marketplace acceptance.
We do not provide legal, tax, accounting, compliance, marketplace, advertising, or professional advice. You are responsible for obtaining your own review before using Outputs commercially or in regulated contexts.
14. Limitation of liability
To the maximum extent permitted by law, Pixer will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, revenue, goodwill, marketplace ranking, ad performance, account access, or business opportunity.
To the maximum extent permitted by law, Pixer's total liability for any claim relating to the service will not exceed the amount you paid to Pixer in the three months before the event giving rise to the claim, or USD $100 if you paid nothing.
15. Changes to these Terms
We may update these Terms as Pixer grows, including to cover new features such as subscriptions, APIs, team workspaces, video, brand kits, integrations, or additional creator-program flows. Continued use of Pixer after updated Terms are posted means you accept the updated Terms.
